Math Stackers, Inc. (“Math Stackers,” “we,” “us,” or “our”) has adopted this Privacy Policy to explain how we, as a small business, collect, use, safeguard, and share Personal Information from or about you (“user,” “you,” or “your”) when you access our websites (www.mathstackers.com and www.mathstackersu.com), including all related information, content, features, tools, products and services (collectively, the "Services"). Depending on your activities when using or accessing our Services, you may, from time to time, be required to agree to additional terms and conditions.

This Privacy Policy applies to information we collect:
- Via the Services.
- In email and other electronic messages between you and Math Stackers via our Services.
- Via your interaction with our advertisements on third-party websites and services, if those advertisements include links to this Privacy Policy.
This Privacy Policy does not apply to information collected by:
- Us through any website, content, application, or service we may offer which does not link to this Privacy Policy.
- Any third party, including through any application or content (including advertising) that may link to or be accessible from or through our Services.
Our Services are hosted in and directed at individuals in the United States. If you are located outside of the United States, you should not access or use our Services.

Information We May Collect
When you use our Services, we may collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“Personal Information”). Personal Information does not include information that is publicly available or de-identified.
We may collect the following information:
- Identifiers including your name, address, billing address, shipping address, phone number, and email address.
- Transaction Information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel, and your purchasing history with us.
- Financial information including credit card, debit card, and payment card information that is collected and used by our payment processor to complete our financial transactions.
- Account Information including your www.mathstackersu.com account username, preferences, and settings).
- Usage Data and Site Activity Information including the web browser you use to access our Services, your internet service provider (ISP), the times you visit the Services, the website you visit immediately prior to visiting our Services, any search queries you make while using our Services, your Equipment’s operating system, the duration of your visits, and the catalogs, brochures, documentation and software for our products that you download.
- Imprecise Location Information such as your city or zip code.
- Communication Information including records and copies of your correspondence with us (including through a customer support inquiry and any email address you use to communicate with us).
- Technical Information including information that identifies the Equipment you use to access the Services, including your IP address, your Equipment’s MAC address, or other similar identifiers.
Note, we do not collect, sell, or share (as defined by law) Sensitive Personal Information.
How We Collect Information
We may collect Personal Information in the following ways:
- Directly from you including when you create an account, visit or use the Services, communicate with us, purchase a product or otherwise procure or use our Services;
- Automatically through the Services including when you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your Equipment, browsing actions, and patterns. This data may include: (a) usage details, (b) device information, (c) user preferences, such as language settings and browser information, and (d) location information. - From Third Parties including business partners or referrers.
Cookies and Other Data Collection Technologies
We may automatically receive and store certain types of Personal Information whenever you interact with our Services. For example, we may use “cookies” and “web beacons” (also called “clear gifs” or “pixel tags”), to obtain certain information when you use or access our Services. You may also delete cookies manually from your device through your internet browser, operating system, or other programs you use to access the Services. Web beacons (also known as web bugs, clear GIFs, or pixel tags) are tiny graphics with a unique identifier, similar in function to cookies, and may be used to track the online movements of users, when an email has been opened, or to provide other information.
How We Use and Share Information
Depending on how you interact with us or which of the Services you use, we may use Personal Information for the following purposes:

To Whom We Disclose Personal Information
We may disclose Personal Information to the following:
- Service providers, Contractors, and Third parties. We may share Personal Information with service providers, contractors, and third parties, such as Shopify and membership.io, that help us with providing our Services, including customer support, email and text message deployment, research and analytics, marketing and advertising services, data processing, management, analytics, fraud prevention, transaction and payment processing, and survey administration.
- Business Partners, Advertisers, and Other Third Parties. With appropriate consent where required, we may share Personal Information with or make it available to our sponsors, partners, advertising networks, advertising servers, and analytics companies or other third parties in connection with our and their marketing, promotional and other offers, as well as product information.

We may also disclose Personal Information to the following entities in the following circumstances:
- Law Enforcement, Regulators, Courts, and other Governmental Authorities. We may share any of the categories of Personal Information we collect, pursuant to applicable law, to respond to subpoenas, court orders, legal process, and other law enforcement measures, to comply with other legal obligations, to respond to an emergency, or otherwise to protect our or the rights, property, safety, or security of other parties, visitors to or users of our Services, or the public.
- Business or Asset Transfers. If we are involved in a merger, acquisition, transfer of control, bankruptcy, reorganization, or sale of assets, or diligence associated with such matters, we may share Personal Information with relevant stakeholders. For example, if another entity acquires us or all or substantially all of our assets, or assets relating to any of our businesses, your information may be disclosed to that entity as part of the due diligence process and may be transferred to that entity as one of the transferred assets.

Some content or applications within our Services, including advertisements, may be served by third parties, including advertisers, ad networks, servers, content partners, or application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Services. Your Rights and Choices
We have created mechanisms to provide you with the following control over your information:
- Marketing Information: If you do not want us to use your email address to promote or recommend our own products and Services, or third parties’ products or services, you may opt-out by replying to any promotional email we have sent you or following the opt-out links on that message. This opt-out generally will not apply to information provided to us related to or to facilitate a purchase, product service experience, or other Service-based transaction.
- Accessing, Updating, and Deleting Your Information: You may contact us as set forth in the Contact Us section below to request access to, correction of, or deletion of Personal Information about you in our possession or control, consistent with your rights as described below. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or negatively affect the information’s accuracy.
- Location Information: As noted above, when you use our Services, we may automatically collect certain information about the device(s) you are using. This includes the precise location of your Equipment through GPS, Bluetooth, or WiFi signals. You may be able to turn off location features on your Equipment.
- Cookies and Automatic Data Collection Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. However, if you disable or refuse cookies, please note that some parts of our Services may become inaccessible or not function properly. In some cases, you may be able to set your browser or email program to not download web beacons.

- California Residents. If you are a California resident, you may have additional personal rights and choices regarding your personal data. Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.
Minors' Data
The Services are not intended to be used by individuals under 18 years of age, and we do not knowingly collect, sell, or share any Personal Information about individuals under the age of 18. If you are under 18, do not use or provide any information to us. If you believe we may have any information from or about an individual under 18, please contact us using the contact details set out below.
Our Services that require a user to complete a registration process before using those areas are solely directed to educators and parents that are at least 18 years of age.
Retention
We will retain and use your Personal Information for the purposes for which we collect it, to comply with our legal obligations, resolve disputes, and enforce our agreements, and as permitted by law.
Relationship with Third Parties
Our Services may contain links to other third-party websites, including social media sites. This Privacy Policy only applies to our Websites and Services. If you click a link on or through our Services that takes you to another website that we do not control, you should confirm you agree with their privacy and information practices before sharing any information with that site.
Certain parts of the Services are hosted by Shopify, membership.io, and other service providers, which collect and process Personal Information about your access to and use of our Services to provide and improve our Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store features on our websites, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of Personal Information collected about these interactions. In these circumstances, Shopify is responsible for the processing of your Personal Information, including for responding to your requests to exercise any rights you may have over use of your Personal Information for these purposes.
